Law about playing multiple songs by same artist?

someone told me there was an FCC rule about playing multiple songs by the same artist in a show? Is this true? Like you can't play more than 3 tunes by the same band in an hour or something like that?

Yes. Some programmers get around this by alternating between Parliament and Funkadelic,
or, say, playing two songs by the Beatles, then
two songs by the Rutles.

i think it is something like: you can't play more than two songs in a row by the same artist. and not more than two times in an hour. wait, if you can't play more than two in an hour then you obviously couldn't play more than two in a row so, that can't be right. i did an all tom waits show before. i think you just shouldn't do it when we record that stuff for webstreaming.

I don't believe it is an FCC rule but rather a sound exchange one. Oh well "F" em!

i think...SO WHAT!

although i don't like playing multiple songs by the same artist in the same show personally, i am certainly supportive of those who do.

I sometimes play two or three songs in a row by the same artist on the 5am-7am slot on friday morns...but usually they take up the whole hour or more cos they are super longers. haw.

anyways, I don't think it matters much if we're not logging playlists for soundexchange, right? right. I'm glad we all agree.

check with delchin but i'm pretty sure this is how the dmca law reads:

In any 3-hour period, one can webcast: A) No more than 3 songs from one album; no more than 2 played consecutively. cool smiley No more than 4 songs from a set/compilation; no more than 3 played consecutively. C) No more than 4 recorded songs by the same artist.

or you could avoid trouble by not playing more than 1 song per artist during any period.

Yeah, variety is great of course, but damn it, whatever happened to the 'classic album side' ? Or artist spotlight, etc.

QUESTION: If one were to get permission from the artist or releaser of compilation, could one then play more than the limit? I dunno, man, it seems kind of ridiculous for freeform radio.

Sounds like a case of multi-dimensionality, in which case, there are no FCC rules governing that, or any rules for that matter. Well, I mean there are *rules*, but I doubt anyone on the FCC would be hip to those rules, or if they were, they'd have to hide the fact from their colleagues on this planet and later represent WCSB at the Multiverse Tribunal, as we're *sort of* their responsibility. Either way, we'd never find out, nor would the FCC, so no worries.


(the original question should probably be brought up at the General Staff Meeting on the 30th if it's really something we should be concerned about??)

EIZ (dronecore) probably has it right, as a former longtime exec here. Tommy Fox once summarized it to me, sometime during his 2nd GM term. To Paraphrase:

The FCC has NO bearing on webcasts. However, webcasting laws prohibit more than three songs by an artist or more than three songs from any one album (comps include) in less than a 3 hour period.

I'll do double shots, etc. sometimes, but I always figured it as weak programming if you limit yourself so much when we have so much good (or even bad) shit here.

My problem with it is that rule is that I want to do a Biography show about diferent artist and such. How am I going to have an auditory biography show with out displaying different examples of an artist work and their acomplishment? They are such dumbasses!

my thoughts exactly, but it can still be done if one plays things from different "projects" by the musician. Also, if during a two hour show, one plays only two songs by the artist or off the recording or whatever, who's to say the programmer before or after one's show hasn't also played some of their stuff (within the three hour window). If someone out there is actually monitoring and logging all the stuff on all the shows to keep up with this crapola, they might as well just admit they're a music junkie and apply for their own show too!!!

There don't seem to be any similar genr shows piggybacking each other right now, like when Bob followed the Watchman (though they were different enough!). Some Great albums have 3 or less songs per side (Kiss ALive!), but you guys aren't as cool or smart like me. Shit, I do 5 hours each week!! Learn tricks to keep it fresh. That's why I add talk and comedy--to not spread the tunes as thin.
